"من حقهم يعرفوا".. عريضة وطنية لدعم تطبيق القانون١٠٥\٢٠١٨ لتحديد مصير المفقودين

دعت رئيسة لجنة اهالي المفقودين في لبنان وداد حلواني الى توقيع عريضة وطنية لدعم تطبيق القانون١٠٥\٢٠١٨ لتحديد مصير المفقودين.

ولفتت الى أنه "لأن من حق أهالي المفقودين والمخفيين قسراً معرفة مصير أحبائهم، ولأن من مشكلات البلد الأساسية إقرار قوانين لا تدخل حيّز التنفيذ، تنادينا كمجموعة أفراد تحت مسمى المنتدى المدني لفرض تطبيق قانون المفقودين والمخفيين قسراً 105/2018 وارتأينا إطلاق عريضة وطنية لهذه الغاية، لأن كل توقيع بيعمل فرق خلونا نحمع آلاف التواقيع بذكرى 50 الحرب".

نحن الموقّعين والموقّعات أدناه هيئات وأفراد، لبنانيون ولبنانيات، نتوجَّه إليكم انطلاقاً من خطاب القسم والبيان الوزاري والتعهّد الوارد في كليهما بالتصدّي لكافة ما يعانيه لبنان من أزمات على كافة الصعد والعمل الجدّي لمعالجتها وإعادة قيامة الدولة من كبوتها.

إن التزام الوثيقتين المذكورتين اعلاه بقضية المفقودين أراحنا وأثلج بالتأكيد قلوب أهاليهم لأن من حقّهم أن يعرفوا مصير أحبائهم أحياءً كانوا أو أمواتا. والدولة عليها موجب بذل العناية الواجبة اتجاه هذه القضية الوطنية.

إن قانون المفقودين والمخفيين قسراً (105\2018) إنجاز هام لنضال أهالي هؤلاء الضحايا على مدار عقود طويلة. وهو ربما الوثيقة الوحيدة منذ نهاية الحرب – مع وثيقة الوفاق الوطني – التي أجمع عليها المجتمع اللبناني وكافة ممثليه السياسيين.

لكن هذا الإنجاز لا معنى له ولا جدوى منه إذا لم يُطبّق.

إنَّ تطبيق القانون هو مدخل لإرساء المصالحة الوطنية الحقيقية، ولإشادة دولة تشارك أولادها في معاناتهم وأضعف الإيمان البحث عنهم.

عشية انتهاء أوّل ولاية للهيئة الوطنية للمفقودين والمخفيين قسراً، وهي هيئة مستقلة، مهمتها إنسانية وتقتصر على البحث عن المفقودين وتحديد مصيرهم، وبمناسبة مرور نصف قرن على انطلاق الحروب اللبنانية المشؤومة،

دعونا نجدِّد معاً العهد بتأمين حق المعرفة لأهالي المفقودين، اليوم قبل الغد، من خلال اتخاذ الإجراءات التالية الكفيلة بتطبيق القانون المذكور، وتأمين استمرارية العمل الذي باشرت به الهيئة الحالية:

● اتخاذ كافة التدابير لتعيين هيئة جديدة فور انتهاء ولاية الهيئة الحالية مطلع تموز ٢٠٢٥

● إقرار موازنة تتناسب مع نوع وحجم المهام المنوطة بالهيئة الوطنية بموجب القانون 105\2018، وهو ما لم يتوافر للهيئة الحالية.

● اصدار التعاميم اللازمة لتوفير تعاون الوزارات والأجهزة الأمنية والإدارات العامة والسلطات القضائية مع الهيئة الوطنية بغية القيام بمهامها.

His Excellency Prime Minister, Judge Nawaf Salam

We, the undersigned individuals and organizations, Lebanese men and women, address you today based on the commitments expressed in the presidential word and the ministerial statement—both of which pledged to confront the various crises Lebanon faces and to work seriously towards resolving them, reviving the state, and restoring its institutions.

Among these commitments, the issue of the missing and forcibly disappeared has brought us, and certainly the families of the victims, great comfort and hope. It is their undeniable right to know the fate of their loved ones—whether they are alive or deceased. The state, in turn, is duty-bound to exercise due diligence in addressing this national cause.

The Law on the Missing and Forcibly Disappeared Persons (Law 105/2018) represents a significant achievement, the fruit of decades of tireless struggle by the families of these victims. It remains one of the few documents since the end of the civil war—alongside the National Accord Document—that has garnered broad consensus among the Lebanese public and all their political representatives.

Yet, this achievement holds no true meaning if it is not implemented.

The implementation of this law is a gateway to achieving genuine national reconciliation and to building a state that shares in the suffering of its people—at the very least by earnestly searching for its missing citizens.

Your Excellency the President,

Your Excellency the Prime Minister,

On the eve of the conclusion of the first term of the National Commission for the Missing and Forcibly Disappeared—an independent body tasked exclusively with the humanitarian mission of searching for the missing and determining their fate—and on the occasion of the fiftieth anniversary of the outbreak of Lebanon's tragic wars,

Let us renew our collective pledge to uphold the right of families to know the fate of their loved ones, today before tomorrow. We urge you to take the following necessary actions to ensure the enforcement of the aforementioned law and the continuity of the work initiated by the current Commission:

● Take all necessary measures to appoint a new Commission immediately upon the conclusion of the current Commission’s mandate in early July 2025.

● Approve a budget that reflects the nature and scope of the tasks assigned to the National Commission under Law 105/2018—a budget that was unfortunately not made available to the current Commission.

● Issue the necessary directives to ensure the cooperation of ministries, security agencies, public administrations, and judicial authorities with the National Commission in fulfilling its mandate.
